Terms of Service

draft — pending attorney review
This is a good-faith plain-English draft written by the operator of NFL Survivor Edge. It has not yet been reviewed by an attorney and is not legal advice.

These Terms are a contract between you and NFL Survivor Edge ("we", "the site"). By creating an account or using the site, you agree to them. If you do not agree, do not use the site.

1. What this service is — and what it is not

NFL Survivor Edge is an analytics and information tool. It reads public NFL data and sportsbook odds, runs models over them, and shows you the output so you can make your own decisions.

we do not host pools
  • We do not operate, host, or administer survivor pools or any other contest.
  • We do not collect, hold, escrow, transfer, or pay out entry fees, prizes, wagers or any other money connected to a pool.
  • We do not accept bets and we are not a sportsbook, a bookmaker, or a daily-fantasy/pick'em operator.
  • Your pool runs somewhere else — Yahoo, ESPN, CBS, a commissioner site, your office, a group chat, a spreadsheet. Your relationship with that pool, its rules, its money and its legality is entirely between you and that operator.
The only money that ever moves through this site is your own optional one-time payment for access to the software described in section 6.

Any entry-fee figure you type into your dashboard is an informational note to yourself. It creates no obligation of any kind on us and does not represent funds we hold.

2. No guarantee of results

Everything on this site is analysis and opinion. Nothing here is betting advice, financial advice, or a prediction we stand behind as fact. Past performance, historical backtests and forward-looking projections are not guarantees of future results.

We hold ourselves to this publicly. Of the factors we have formally tested and published in the Edge Lab, most showed no predictive edge at all — rest differential, divisional matchups, home underdogs, coaching head-to-head, surface and altitude, and trap-game spots all came back flat, and the referee-crew effect showed up in penalty volume but not in market outcomes. One factor survived testing with real but limited applicability. Our own published research is the reason we make no promise about your results.

You are solely responsible for your own picks. Survivor pools are substantially luck-driven; you can follow every recommendation on this site and still be eliminated in week one.

3. Data accuracy

Odds, schedules, injury reports, box scores, weather and player data come from third-party sources including The Odds API, Highlightly, nflverse and OpenWeather. Those sources can be delayed, incomplete, revised after the fact, or simply wrong, and coverage varies by season and by data set. We provide all data "as is" and are not liable for its accuracy, completeness or timeliness. Always confirm the actual game state and your pool's rules with your pool operator before locking a pick.

4. Eligibility

You must be at least 18 years old to create an account or use the site. By registering you represent that you are 18 or older, that the information you provide is accurate, and that you are responsible for keeping your login credentials secure and for all activity under your account. One account per person.

5. Free tier and the 10-day trial

6. Pricing, payment and access period

7. No refunds

All purchases are final and non-refundable, except where a refund is required by law.

The reason is deliberate: you get to evaluate the product completely before paying anything. The free tier is fully functional for one pool and one entry, and the 10-day trial unlocks every paid feature with unlimited pools and entries without a credit card. That evaluation period is the trial — the purchase comes after you already know exactly what you are buying. Because access is granted immediately and in full on payment, and because the value of in-season analysis is time-sensitive, we do not refund after purchase.

8. Acceptable use and intellectual property

The site, its design, its written research, its model outputs and its derived data sets are owned by us or our licensors and are protected by copyright. You get a personal, non-exclusive, non-transferable licence to use the site for your own pool play. You may not:

Underlying NFL statistics and sportsbook odds remain the property of their respective sources and are used subject to their terms. You retain ownership of the pool data you enter; you grant us the licence needed to store, process and display it back to you.

9. Disclaimer and limitation of liability

The service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant uninterrupted or error-free operation.

To the maximum extent permitted by law, we are not liable for any indirect, incidental, consequential, special or punitive damages, or for any lost pool entry fees, lost prizes, lost winnings, lost profits, lost data, or losses arising from a pick you made or did not make. Our total aggregate liability for any claim relating to the service is limited to the amount you actually paid us in the twelve months before the claim — which for most users is $0.00 and at most $19.95. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

You agree to indemnify us against claims arising from your misuse of the service or your breach of these Terms.

10. Suspension and termination

You may delete your account at any time. We may suspend or terminate an account, with or without notice, for breach of these Terms, abuse of the service, fraudulent payment, or unlawful use, and may discontinue the service or any feature. Termination for breach does not entitle you to a refund. Sections 2, 3, 8, 9 and 11 survive termination.

11. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction. Claims must be brought individually and not as part of a class action. Nothing here waives rights you hold under mandatory consumer law where you live.

12. Changes and contact

We may update these Terms; the "last updated" date above changes when we do, and we will email account holders before a material change takes effect. Continued use after that counts as acceptance. See also our Privacy Policy. Questions: support@nflsurvivoredge.com.
